Moreover, the bill could grant the Gardaí broad power to seize personal items like cell phones and laptops. These aspects of the legislation pose a real threat to freedom of speech and civil liberties in Ireland.

However, we believe that expressions of deep offense, which may not reach a criminal threshold, should be managed through other means such as education and countered by more free speech rather than criminalization.

We want the Incitement to Hatred and Hate Crime Bill be revisited with the explicit goal of strengthening freedom of expression and civil liberties. We also believe that other forms of hate speech, which may cause deep offense but do not reach a criminal threshold, should be combated by other means—including education and vigorous free speech by all—not by giving the government the blunt instrument of search and seizure.
